Tavern bankruptcy trustee appealing restaurant name ruling

According to Crain's New York, the bankruptcy trustee responsible for collecting and eventually distributing the restaurant's assets to creditors is appealing the judicial decision awarding ownership of the "Tavern on the Green" name to New York City. The Tavern's former operators, the LeRoy family, had contended that they owned the rights to the name, estimated to be worth as much as $19 million.

An appellate decision reversing the U.S. District Court ruling and awarding ownership of the name to the LeRoy family could work to the benefit of the restaurant's creditors, which include the workers' union, the New York Hotel Trades Council. According to the Crain's article, winning the rights to the Tavern name could free former Tavern operator Jennifer LeRoy of much of her company's debt and would be a key factor in her decision whether to submit another bid to operate the restaurant.
